Why the Interview Decides Most Blue Badge Cases

By the time a council invites you to an interview under caution, it usually has evidence that the badge was used when the holder was not there. What it often does not have is evidence of why, or of what you understood about the rules. The interview is where it tries to get that.

Your answers can decide whether the case ends with no further action, a caution, a Section 117 charge, or a Fraud Act charge that records dishonesty. Mitigation after a conviction can reduce a sentence. Preparation before the interview can change the charge, or prevent a prosecution altogether.

What a Solicitor Does Before the Interview

Most of the value is in the preparation.

  1. 1

Finding Out What the Council Has

We contact the investigating officer to ask what the allegation is and what evidence will be put to you. This is often called pre-interview disclosure.

  2. 2

    Reviewing Your Account

We go through what happened with you in private, identify the points that help and the points that worry you, and check your account against the evidence.

  3. 3

    Deciding the Approach

Together we decide whether you should answer questions, give a prepared statement or decline to comment, and prepare you for the questions you are likely to face.

  4. 4

    Arranging the Date

If the interview is too soon, we ask the council to move it so that you are properly prepared.

What a Solicitor Does in the Interview

Your solicitor is there to protect you, not to answer for you. In the room they:

  • ✓Sits beside you throughout and makes sure the interview is conducted fairly
  • ✓Intervenes if questions are unfair, misleading or based on assumptions
  • ✓Asks for a break if you need private advice part-way through
  • ✓Reads out or hands in a prepared statement if that is the approach agreed
  • ✓Makes sure your explanation and any evidence that helps you are recorded

Afterwards, they can make written representations to the council about the evidence and the public interest before it decides whether to prosecute.

Answering Questions, a Prepared Statement or No Comment

There are three broad ways to approach an interview under caution, and the right one depends on the evidence and on your account:

  • Answering questions lets you explain fully, but answers given without preparation can be incomplete or inconsistent with the evidence.
  • A prepared statement puts your account on record in your own words, prepared with your solicitor, and you then decline to answer further questions.
  • No comment means declining to answer. It can be the right choice where little has been disclosed, but in some circumstances a court can draw conclusions from silence.

This is a judgement to make with a solicitor once you know what the council has. It is not something to decide on the day.

Council Interviews, Police Interviews and PACE

Most Blue Badge interviews are carried out by council investigators, usually at council offices and described as voluntary. Council investigators are expected to follow the same Police and Criminal Evidence Act (PACE) codes as the police, so you are cautioned, the interview is recorded, and what you say can be used in court. A “PACE interview” and an “interview under caution” usually mean the same thing.

The main practical difference is that there is no duty solicitor at council offices. At a police station you can ask for free legal advice; for a council interview you normally need to arrange your own solicitor.

Blue Badge interview under caution explained

Can I Bring a Solicitor to a Council Interview?

Yes. You are entitled to legal advice, and you can have a solicitor with you throughout the interview. Let the council know in advance that you will be represented. If the date does not leave enough time to arrange a solicitor, ask for it to be moved; that request is routine.

What It Costs and How Quickly We Can Attend

Your first discovery call is free. If you decide to go ahead, the solicitor will give you a clear quote for preparing for and attending the interview before any work begins, and many offer a fixed fee for this stage.

Solicitors in our network can often attend within days, and sooner where an interview is urgent. The earlier you get in touch, the more time there is to obtain disclosure and prepare properly.

Interview Already Booked? What to Do Today

  1. Find the interview date, time and place in the council's letter.
  2. Do not call the investigating officer to explain your side.
  3. Write down what happened while you still remember it, for your solicitor only.
  4. Contact us and, if needed, ask the council to postpone while you get representation.

Interview Under Caution Solicitors: Common Questions

Can I bring a solicitor to a council interview under caution?

Yes. You are entitled to legal advice before and during an interview under caution, and you can bring a solicitor with you. If the council has set a date that does not give you time to arrange one, ask for the interview to be moved. Councils usually agree to a reasonable request.

Is there a free duty solicitor for council interviews?

The duty solicitor scheme covers people interviewed at a police station. Council interviews usually take place at council offices as voluntary interviews, so you normally need to arrange and pay for your own solicitor.

Should I answer questions, give a prepared statement or say no comment?

It depends on the evidence and your account, which is why the decision should be made with a solicitor after they have seen what the council discloses. Each option has advantages and risks, and in some circumstances a court can draw conclusions from silence. There is no safe default.

How quickly can a solicitor attend?

Often within days, and sometimes sooner for an urgent interview. If your interview is very close, contact us straight away and ask the council to postpone while you arrange representation.

What if I have already been interviewed without a solicitor?

It is not too late to get advice. A solicitor can review what you said, consider whether anything needs correcting or adding, and make representations to the council before it decides whether to prosecute.

Professionals at Risk

Are you a Nurse, Teacher, Social Worker, or Financial Professional, or in any role that requires a DBS check or professional registration? A Blue Badge conviction appears on a DBS check and can be reported to professional bodies like the NMC, GMC, or FCA. Many employers ask about unspent convictions, and this offence does not disappear quickly.

We specialise in out-of-court settlements for professionals. In many cases, early intervention prevents any prosecution from being recorded at all.
