This checker is built around the DBS filtering rules set out in the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 and the Police Act 1997 (Criminal Records) Regulations 2002, as amended. It reflects the position for adults in England and Wales.
The key distinction is between Section 117 of the Road Traffic Regulation Act 1984 (the standard Blue Badge misuse charge) and Fraud Act 2006 offences. Only offences not on the prescribed "never filter" list can be removed from DBS certificates over time. Fraud Act offences are on that list and will always appear on enhanced and standard DBS checks.
Results also reflect the regulator-specific disclosure rules that apply to excepted positions — roles where the Rehabilitation of Offenders Act protection does not apply and spent convictions must still be disclosed.
